Acceptable Use Policy

Plain-English summary. We built Uploadex to help you move files quickly and privately. This policy tells you what you must not upload or do on the Service. Breaking these rules will get content removed and, for serious breaches, your account suspended or terminated.

This Acceptable Use Policy ("AUP") forms part of the Terms of Service between you and Brixial Technologies Pvt Ltd, the operator of Uploadex. It applies whenever you upload, share, access or interact with any content on the Service, whether or not you are signed in. It is written to comply with the obligations of an "intermediary" under §79 of the Indian Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

1. Prohibited content

You must not upload, share or otherwise make available through the Service any content that:

  • Is child-sexual-abuse material (CSAM), or otherwise sexually exploits or endangers a minor. We preserve and report such material as required by law and cooperate with competent authorities.
  • Contains, or links to, malware, viruses, ransomware, cryptominers, keyloggers, rootkits, or other malicious code.
  • Infringes the intellectual-property rights of any third party, including copyrights, trademarks, patents, trade secrets, or moral rights. Copyright holders can submit a notice through our DMCA / Copyright page.
  • Contains personal data of another person, processed without a lawful basis or appropriate consent (including doxing, leaked databases, and stolen credentials).
  • Is defamatory, libellous, grossly harmful, harassing, threatening, abusive, invasive of another's privacy, hateful, or racially or ethnically objectionable.
  • Is non-consensual intimate imagery (sometimes called "revenge porn"), deepfake sexual imagery, or other media produced without the informed consent of the people depicted.
  • Incites, promotes, glorifies, or provides instructions for terrorism, violent extremism, mass violence, or organised crime.
  • Promotes or facilitates the sale of firearms, controlled drugs, regulated weapons, or other goods whose supply is restricted by law to you or the recipient.
  • Impersonates any person or entity, or misrepresents your affiliation with a person or entity, to deceive recipients.
  • Contains deceptive content, phishing, fraudulent schemes, pyramid schemes, or scams.
  • Is unlawful under the laws of India or any jurisdiction from which you upload or to which you share the file, including content that violates Rule 3(1)(b) of the IT Rules, 2021.

2. Prohibited conduct

You must not, and must not attempt to, use the Service to:

  • Gain unauthorised access to any account, data, system or network, whether ours or a third party's.
  • Probe, scan, fuzz, benchmark or penetration-test the Service without prior written permission. Good-faith security research is welcome through our vulnerability-disclosure programme at [email protected].
  • Interfere with, degrade or disrupt the Service, including by launching denial-of-service attacks, transmitting excessive traffic, or knowingly uploading malformed requests.
  • Circumvent or attempt to circumvent rate limits, file-size limits, authentication controls, geographic restrictions or other technical measures.
  • Scrape, crawl, harvest or replicate the Service or its content without our prior written permission, or use automated tools that place an unreasonable load on the Service.
  • Resell, sublicense, or white-label the Service, or use it to provide a competing service, without a written agreement with us.
  • Use the Service in a way that violates the Privacy Policy, the Terms of Service, or any applicable law or regulation.
  • Send unsolicited bulk communications, spam, or phishing links using the Service.
  • Manipulate download counters, rankings, or any metric displayed by the Service.

3. How we detect violations

We use a combination of automated and manual measures to keep Uploadex safe. Automated scans compute a cryptographic hash of every uploaded file and compare it to industry hash-lists of known illegal content and malware. Hash-matching does not require us to open or read the file. We also apply rate-limits, abuse-heuristics and anomaly detection at the network edge.

Outside of these automated processes, we do not routinely inspect the contents of user files. We may review content when we receive a complaint, an official order, or a specific trust-and-safety alert, and we limit access to authorised personnel operating under audit logging.

4. Enforcement

If we determine, in our reasonable judgement, that you have violated this AUP, we may take one or more of the following actions:

  • Remove, disable, quarantine or label the offending content.
  • Send you a warning with an opportunity to remedy the violation.
  • Suspend your account temporarily, or permanently terminate it for serious or repeated violations.
  • Retain or preserve the content and associated account data where required by law or by a lawful order from a competent authority.
  • Refer the matter to law enforcement or a competent regulator.
  • Withhold access to the Service from devices, networks or identifiers associated with the violation.

We aim to choose the least intrusive measure reasonably available. Actions are logged and auditable internally.

5. Reporting abuse

If you believe content on Uploadex violates this AUP or is otherwise harmful, please report it. Clear, specific reports help us act quickly.

Please include the Uploadex URL, the specific reason for your report, and any supporting information we can use to evaluate it.

6. Appeals

If we remove content or restrict your account and you believe it was in error, you may appeal by emailing [email protected] within 30 days. We aim to review appeals within 10 business days. Where the removal was made under our DMCA procedure, the counter-notice process applies instead and is described on our DMCA page.

7. Changes to this policy

We may update this AUP as threats, laws and the Service evolve. When we make a material change we will revise the "Last updated" date above and, for material changes, notify active accounts at least 14 days before it takes effect. Continued use of the Service after the change takes effect means you accept the revised AUP.
